In November 2022, Kentucky Governor Andy Beshear instituted significant legal safeguards for medical cannabis patients with the introduction of Executive Order 2022-798. This marked the state's first major step in legalizing medical marijuana use.
This order, which came into effect from January 1, 2023, allows for conditional, full pardons to individuals charged with marijuana possession. The pardon terms, however, require that the patients procure cannabis legally outside Kentucky.
Patients are obliged to have written evidence of their purchase, which must specify the date and physical location of the cannabis transaction.
To qualify, individuals must be diagnosed with a recognized medical condition and should not hold more than eight ounces of medical cannabis.
It is compulsory for patients to carry a certification authored by a licensed physician when in possession of cannabis.
Given that cannabis is illegal in Kentucky, those found guilty of unauthorized possession could potentially be sentenced to a maximum of 45 days in jail.
The only means to circumvent these legal repercussions is by acquiring a medical marijuana certificate as prescribed by Executive Order 2022-798. By strictly complying with each stipulation, you qualify for a full pardon for possession.
An official Kentucky physician written recommendation must be obtained from a medical physician and submitted with the application. To schedule your risk-free appointment to see a ARCannabisClinic approved marijuana doctor in Kentucky, click here.

As Kentucky does not operate a dedicated medical marijuana program, patients are not issued a state medical card, neither are they subjected to state registration fees or a specific Kentucky-based cannabis sales tax.
Despite the absence of a state-issued card, patients are still obligated to keep a copy of their written certification at all times when they possess cannabis.
Caregivers are required to be at least 21 years old and shoulder substantial responsibility for the medical marijuana patient under their care.
They need to furnish their name, address, and contact number to ARCannabisClinic.
It's essential for potential caregivers to know that their names will be mentioned on the certification, and they hold the duty of ensuring the possession of the certification form at all appropriate times.

Since cannabis is prohibited in Kentucky, there are no locations within the state for patients to buy marijuana.
According to the Executive Order, patients are required to purchase cannabis lawfully from a licensed provider located anywhere in the United States, except for within Kentucky.
Once you obtain certification, it's your responsibility to conduct necessary research to determine where cannabis can be bought legally.
Take for instance the neighboring state of Ohio, which runs its own medical program; however, this program is exclusively available to Ohio residents.
A few states recognize out-of-state medical cards through their reciprocity programs, but Kentucky's current certification procedure isn't part of a broader medical cannabis program.
For Kentucky residents, the most secure approach to buy marijuana would be to make a purchase in a state where recreational marijuana use is legalized, while meticulously following every step of the Kentucky certification process.
